Introduction

Probate challenge: international beneficiaries 

A former Australian citizen who had lived and settled in the UK for many years sadly passed away, leaving their estate that included: 

  • A UK property 
  • Cash holdings 
  • UK-based investments 

All of which were to be distributed to her daughter and granddaughter, who were both still living in Australia. 

In her will, a detail many people overlook, she left specific instructions that Optimal Currency should be used to transfer the funds from her estate from GBP into AUS $ in order to send them over to Australia. 

It was a simple request that would later prove an astute piece of financial planning. After all, probate with any cross-border financial transfers creates an even more complex mix at a time of great stress for all parties.  

In addition, there was conflict between the beneficiaries which made the job of the UK-based executor all the more complicated.  

What followed was an 18-month probate process involving: 

  • A UK solicitor 
  • A UK-based executor  
  • Two beneficiaries in Australia 
  • A large sum needing to be transferred overseas 

The solicitor’s bank account, despite holding client funds, couldn’t manage the international transfer needs effectively.

That left the executor stuck: the estate needed distributing, the beneficiaries expected the funds, but the operational route didn’t exist. 

This is where many executors discover the reality that if an estate requires any cross- border transactions, neither the deceased account, the executor’s account, or the solicitor’s account is set up as the right tool for the job.
